Claims Against the United Counties of Prescott and Russell
You can decide to file a claim against the United Counties of Prescott and Russell (the “UCPR”) if you believe that the UCPR were negligent in their maintenance of roads or other infrastructure, which caused bodily injury or damages to your property.
Typical claims include requests for compensation for:
- damages to cars caused by potholes;
- damages to property caused by drainage obstructions; and
- damages caused by municipal vehicles, such as mailboxes.
Important Points to Consider Before Filing a Complaint
If
you have automobile or property insurance, these should be your first
course of action in the event of damages. Your insurance coverage may in
fact be more extensive than any payment that could be made by the UCPR.
Then, if your insurance company determines that the UCPR were
responsible, it may seek to recover damages against the UCPR on your
behalf.
The UCPR only make payment in cases where their actions
were considered negligent. Simply put, “negligence” means the failure to
take reasonable care to avoid causing injuries or damages. The mere
fact that you suffer injuries or damages does not automatically mean
that the UCPR were negligent.
